The Kyiv prosecution successfully defended the right of residents to freely access the Dnipro embankment, which had been unlawfully claimed by residents of a luxury residential complex. The Supreme Court agreed with the prosecution's arguments and terminated the private company's ownership of the coastal infrastructure in the Berkovshchyna area, covering over 2,300 square meters within the river's protective coastal zone.

This embankment is located near the residential complex at 14 Dnipro Embankment Street in the Darnytsia district of the capital. The owners of the hydraulic structures had set up barriers, restricting access to the river for people who wish to stroll there but do not reside in the complex.

The hydraulic structures, according to technical documentation, were constructed as an embankment nearly 500 meters long, designed to protect against erosion. In 2020, the private company registered ownership rights over them, despite the fact that these structures are located on a municipal land plot of the water fund covering over 3.1 hectares, valued at over 67 million UAH. The prosecutor emphasized that this registration results in the alienation of the water fund land from the community's ownership and creates barriers for residents to access the Dnipro freely.

The Supreme Court concurred with the prosecutor's rationale: ownership rights to the hydraulic structure cannot be registered to anyone.
