The Kyiv City Prosecutor's Office has charged the head of the executive body of the Kyiv City Council and the former head of the municipal enterprise «ATP KМDA».
Their actions have been classified under Part 5 of Article 191 of the Criminal Code of Ukraine, specifically as misappropriation of property by an official through abuse of office, committed by a group of individuals in particularly large amounts.
It has been established that the suspects ordered and paid for façade improvements and other repair works in an office building on Boris Hrinchenko Street in Kyiv, which has already been removed from communal ownership and belongs to private individuals.
In total, the suspects spent nearly 1.3 million hryvnias on repairs. Furthermore, the municipal enterprise does not even have lease agreements for the repaired premises, meaning that public funds were effectively used to pay for work in a private building.
The issue of choosing preventive measures for the suspects is currently being resolved.
The penalty under this article includes imprisonment for up to twelve years, along with a prohibition on holding certain positions or engaging in specific activities for up to three years, and confiscation of property.
Petitions for preventive measures in the form of detention with the possibility of bail equivalent to the amount of damages incurred have been prepared for the court.
